1. Introduction

These Terms of Service govern your access to and use of maisonmargarita.co.uk and the purchase of any products from Maison Margarita (BM Commerce Ltd). By browsing our website or placing an order, you agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

2. Eligibility & Account Responsibilities

By using our website and placing an order, you represent and warrant that you:

Are purchasing products strictly for private consumer and domestic use.

3. Products, Imagery & Pre-Orders

Product Representation: We make every effort to display the colors, finishes, dimensions, and specifications of our furniture accurately. However, actual colors may vary depending on monitor settings, and natural materials (such as timber, marble, or textiles) will feature natural grain, tone, and texture variations.
Pre-Orders: Select curated pieces are available on a Pre-Order basis when stock is allocated for upcoming production runs or shipments. Estimated lead times (typically 45–60 business days / 8–12 weeks) are clearly displayed on the product page prior to purchase. Pre-Orders follow the standard cancellation and return rights outlined in our Return Policy.
Availability & Updates: We reserve the right to modify, update, or discontinue any product or range at any time without prior notice.

4. Orders & Contract Formation

When you place an order, you are submitting an offer to purchase products under these Terms. A binding contract between BM Commerce Ltd and you is formed only when:

Your payment has been successfully processed at checkout.
Stock allocation and order validation are confirmed with our fulfillment partners.
You receive an official Order Confirmation Email from us.

Order Cancellations & Refusals:

We reserve the right to decline or cancel an order prior to dispatch for reasons including, but not limited to:

Unforeseen product stock unavailability.
Genuine pricing, specification, or typographical errors on the product page.
Suspected fraudulent or unauthorized activity.

You may cancel any standard or pre-order item prior to courier dispatch for a full refund. Once dispatched, standard return procedures apply.

5. Pricing & Payment

VAT & Currency: All prices are displayed in Pounds Sterling (GBP £) and are inclusive of UK Value Added Tax (VAT) at the prevailing rate.
Exclusions: Stated product prices exclude outbound delivery charges and regional remote area surcharges, which are calculated at checkout.
Payment Terms: Orders must be paid in full at checkout via our authorized payment gateways. Orders will not enter dispatch processing until full cleared funds are received.

6. Shipping, Delivery & Access

Delivery Terms: Delivery lead times are estimates and depend on courier routes, regional freight access, and warehouse locations. Full delivery details are set out in our Shipping Policy. Under UK law, standard items will be delivered within 30 calendar days unless an extended pre-order timeframe was explicitly agreed upon at checkout.
Delivery Access: It is the customer's responsibility to measure doorways, hallways, and access routes prior to purchasing. If a delivery cannot be completed due to unmeasured access restrictions or an agreed appointment being missed without 24 hours' notice, reasonable re-delivery or carrier freight recovery fees may apply.

7. Returns, Refunds & Statutory Rights

Returns and refunds are processed in accordance with our Return & Refund Policy.

UK Consumer Rights: Nothing in these Terms limits, restricts, or affects your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.
Right to Cancel (14 Days): You have the legal right to cancel and return your order within 14 calendar days of delivery for any reason.
Damaged or Defective Items: We request that you inspect your delivery promptly. Damaged, defective, or incorrect items should be reported to contact@maisonmargarita.co.uk with photos of the damage and outer packaging. Under the Consumer Rights Act 2015, you maintain a 30-day statutory right to reject faulty goods for a full refund or replacement.
Return Condition: Items returned under your 14-day cancellation right must be complete and handled with reasonable care. We reserve the right to apply a deduction from your refund for any loss in value resulting from unnecessary handling, assembly, or damage while in your possession. Return shipping costs for standard change-of-mind returns remain the responsibility of the customer.

8. Intellectual Property

All content on maisonmargarita.co.uk—including text, graphics, product photography, logos, branding, typography, and page design—is the exclusive intellectual property of BM Commerce Ltd or its licensors.

You may not copy, reproduce, modify, distribute, or display any part of this website without our prior written consent.

9. Third-Party Links & Content

Our website may contain links to external websites, social media platforms, or third-party services. We are not responsible for inspecting, evaluating, or guaranteeing the content or policies of third parties. Accessing external links is done at your own risk.

10. Platform Operations & Shopify

Our online store is hosted on Shopify Inc., which provides the e-commerce engine that enables us to sell our products to you. Your sales contract is entered into directly with BM Commerce Ltd t/a Maison Margarita, not Shopify Inc. Shopify is not liable for product quality, delivery, or returns fulfillment.

12. Severability & Entire Agreement

If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that section shall be severed without affecting the validity and enforceability of the remaining sections. These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and BM Commerce Ltd.

13. Governing Law & Jurisdiction

These Terms of Service and any non-contractual obligations or disputes arising out of them are governed exclusively by the laws of England and Wales. You and BM Commerce Ltd agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute.

We reserve the right to update or modify these Terms of Service at any time. Any changes will be published directly on this page with an updated revision date.
